Recommend do not use "Delaware Corporate Agents, Inc"

After years of using them (since 2001), they have become unresponsive and worse than useless. They have actually become very problematic for others. We are recommending everyone avoid the organization "Delaware Corporate Agents", Inc aka delcorp.com like the plague! Details included.

 

Back in late 2001 I used Delaware Corporate Agents, Inc, one of their websites is "www.delcorp.com" aka "delcorp.com" to create one of my technology LLCs. They started out okay, but over time have become problematic. They are severely overpriced now compared to all of their competitors (their pricing was average back in 2001, but about 2-4 times higher than most now), and they are extremely difficult to get a response from about anything except paying them.

Worse yet, I made the terrible mistake of suggesting a friend wanting to file a 501(c)3 use them. I am so very very sorry about that. It is not half a year later and they Delaware Corporate Agents, Inc still hasn't resolved the issue appropriately and has completely screwed up the wonderful non-profit's efforts at filing.

I have since dropped Delaware Corporate Agents and moved to another provider. But of course Delaware Corporate Agents, Inc is still trying to bill me. Sheesh!

I tried filing a complaint through the BBB about their incompetence and terrible handling, but the BBB eventually responded 2 months later with a boiler plate response that states about lawyers:

" The BBB does not handle complaints about the following:

...

  • Complaints raising issues concerning the competency of doctors, dentists, licensed therapists, veterinarians, and lawyers. We would handle billing disputes that do not involve underlying competency issues.

...."

 

Sigh.

The hope is that this blog posting will get spread far and wide over time to help warn people away from this terrible provider.

Been with delcorp.com them since 2002. Started out fine back then, didn't interact with very much. However this year, in trying to reach them, they have impossible to reach by phone. I have in the past noticed increasing delays in email response, sometimes weeks or months later, or not at all. This seems to just have happened in the past few years, used to be very responsive, and used to be able to call and speak with a human being. I've tried to call them several times over the past few months and only get voicemail, and nobody calls back after I leave a detailed message with phone number asking for call back. This particular BBB complaint is actually out of concern over what I have witnessed with their handling of another business, that is a friend's, not my own business. This filing is meant to be a warning to people to beware. Late last year a friend asked where they should go to try to incorporate their non-profit, so I referred the friend to Delaware Corporate Agents, Inc. (delcorp.com) for them to help them file a 501(c)3. I was hoping to help the business owner, so I was CC'd through the entire process, helping the friend. The friend wanted an agent to handle filing the correct 501(c)3 paperwork. I now very much regret referring this friend to Delcorp.com, they have made a terrible mess of what should have been a relatively simple process, causing a lot stress and incredible amounts of lost productive time trying to get delcorp.com to fix their mistakes, and still no resolution now a couple months down the road. * Delcorp for some strange bizarre reason filed as completely different filing as a 501(c)6! That is not even close, and does not fit the business's need at all. There were numerous other filing mistakes made by delcorp.com, not the customer, but delcorp.com is trying to blame the customer for the mistakes. * They also inexplicably filed the NEW business with a date a year earlier! There were also a number of other typos (a bit easier to excuse, but the other two mistakes are huge and bizarre!). When the friend realized the mistake, after seeing the filed paperwork come in, when receiving the paperwork much later down the road and showed me, I pointed out that it was filed completely wrongly, because of the date and the 501(c)6. When the friend contacted them to fix it, they dragged their feet for weeks and weeks in their responses. Now not only is Delcorp.com not fixing the problem, they are now trying to blame the friend for delcorp.com's mistakes, and making claims ludicrous claims directly in opposition to all the emails I was CC'd on. The friend just wants them to fix the mistakes delcorp made and make the correct filing, else cancel the whole thing and give back the small non-profits money so they can go to another agent and start the process all over again. At this point delcorp.com is refusing both. This is very disappointing. Delcorp.com didn't know any of my involvement, I have just been trying to get a hold of a human being to make contact and nobody ever answers the phone or calls back after leaving a voice mail asking them to call me. I am now researching my options to move my businesses to another agent. I am researching trying to find someone better. In so researching, I have discovered delcorp.com is charging me a lot more each year than most other agents. I hadn't bothered to check over the years. I don't know if this changed over the past 17 years or what happened, but they appear to be charging me several times more than other agencies. This has not (yet) gone to litigation, though a lawyer has had to be brought in. It would be much better to just fix the issues. If delcorp.com values their integrity and reputation, they should, instead of turning the blame on the customer, take responsibility and fix the problem, and fix the filing mistakes, deliver the 501(c)3 (not 501(c)6!!!) correctly as requested, and then all will be well. If they have to eatt some added costs themselves to fix the problem, that would reflect well on them, and be chalked up as an honest clerical mistake. At this point they are refusing, and blaming the customer. From now on, not only will I be moving my business elsewhere, but warn people to beware. I'm not sure what happened over the years that they have deteriorated so much, but it is very disturbing, be warned. The way they have completely botched an easy filing, and how poorly they have handled responding, now over several months, and then trying to blame it on the customer when all of the mistakes were clearly delcorp.com's mistakes, is inexcusable. Beware, they are not what they once were.

If delcorp.com values their integrity and reputation, they should, instead of turning the blame on the customer, take responsibility actually deliver the correct service requested (correctly filed), fix the problem by doing whatever is necessary to fix the filing mistakes, deliver the 501(c)3 (not 501(c)6!!!) correctly as requested, and then all will be well. * Fix filing: 501(c)3 no 501(c)6 * Correct filing date (not a year before the entity existed) * The other typos for names and such. If they can't do this, then cancel everything, and fully refund the customer so they can start over with another agent. If they have to eat some added costs themselves to fix the problem, that would reflect well on them, and this could all be chalked up as an honest clerical mistake. At this point they are refusing, and blaming the customer. The customer is willing to do whatever is necessary just to make this work, but delcorp to date has dragged this out for months, and still have not fixed the problem.

In reviewing the issue you brought to us, it appears that the BBB cannot directly help you with this issue.  The BBB does not handle complaints about the following:
  • Employer/employee disputes.
  • Complaints against government agencies unless the government operates a utility and the complaint involves administrative matters such as billing.
  • Complaints against individuals who are not engaged in a business (e.g., a person who sells their personal car through a classified advertisement).
  • Complaints alleging discrimination or violation of similar statutory/constitutional rights.
  • Complaints alleging criminal violations by company employees except for complaints alleging theft by company employees while performing services.
  • Complaints raising issues concerning the competency of doctors, dentists, licensed therapists, veterinarians, and lawyers. We would handle billing disputes that do not involve underlying competency issues.
  • Complaints that challenge the validity of local, state or federal law. For example, we would not accept a complaint against a cable company seeking a change in rates set by law. We would accept a complaint against a cable company alleging that its charges were inaccurately computed in accordance with applicable rates.
